Legal framework

Jet skis are regulated as recreational craft under Ley 14/2014, de Navegación Marítima and Real Decreto 607/1999, the regulation that makes third-party liability insurance compulsory for pleasure craft — and which names jet skis (motos náuticas) expressly. The compulsory-insurance threshold is an engine of 3.7 kW (about 5 HP) or a hull over 2.5 m; every production jet ski is far above it, so every jet ski used in Spanish waters must carry a valid liability policy.

Compulsory liability minimum

For craft up to 6 m — which covers every jet ski — the compulsory minimum liability is €120,000. It pays for injury to third parties (including swimmers), damage to other vessels and port property, pollution clean-up and wreck removal. Most owners take a higher voluntary limit, as the extra premium is small and a serious injury claim can exceed the legal minimum.

Licences — Patrón de Moto Náutica

Spain has specific jet-ski licences, separate from boat licences, graded by engine power:

  • Patrón de Moto Náutica C — machines up to 55 HP
  • Patrón de Moto Náutica B — 55 to 110 HP
  • Patrón de Moto Náutica A — over 110 HP (most modern machines)

RYA Personal Watercraft certificates and the ICC are usually accepted for visiting riders — we confirm equivalence with the insurer before the policy is issued. Rules of the water

  • Daylight hours only — jet skis may not be used at night
  • Stay outside marked bathing zones; enter and leave the beach through the marked channels
  • Speed is limited close to the shore — 3 knots within 200 m of a beach
  • A life jacket is compulsory for the rider and any passenger
  • The 0.5 g/l blood-alcohol limit applies on the water, exactly as on the road

Standard exclusions

Cover does not include:

  • Riding without a valid licence for the machine's power class
  • Racing, bets or competitions, unless declared
  • Commercial hire without commercial cover
  • Riding over the 0.5 g/l alcohol limit
  • Riding at night or inside closed bathing zones
  • Gradual wear and tear, corrosion and mechanical breakdown

Jet Ski Insurance in Spain

Why a Boat or Yacht Policy Is Not Enough

A jet ski needs its own policy. Standard Spanish pleasure-craft wordings expressly exclude personal watercraft — the Generali Náutico boat conditions, for example, exclude "jet-skis (personal watercraft) and any other vehicle or device with a motor" from all property cover. So a jet ski carried on the deck of a yacht, stowed in the tender garage or towed behind a boat is not covered by the boat's policy — a point that catches many owners out. The yacht's tender can usually be declared on the yacht policy; the jet ski cannot.
