Spanish Insurance Law: Constructor's Liability & Decennial. Key Facts, Limits & Exclusions
The legal framework, waiting periods, exclusions and sources every buyer should know. We link the sources inline to the BOE (Boletín Oficial del Estado) and the Spanish regulators.
Legal framework
Decennial structural insurance (Seguro Decenal) is mandatory for new residential construction under Ley 38/1999 de Ordenación de la Edificación (LOE). The cover is a 10-year structural warranty running from the date of acta de recepción (final acceptance certificate). Without it, the building cannot be registered in the Property Registry and the title deed (escritura pública de obra nueva) cannot be executed.
The three-tier LOE warranty system
Article 17 of the LOE sets three tiers of mandatory builder warranty:
- 1 year — finishes and minor defects (paint, tiles, doors)
- 3 years — habitability defects (insulation, ventilation, non-structural water-tightness)
- 10 years — structural defects in load-bearing parts (foundations, columns, beams, slabs, walls)
Only the 10-year structural cover needs insurance under the LOE. The shorter warranties are direct builder duties, but RC obras insurance (see below) covers them in practice.
Self-builders (autopromotor)
Article 19.1 LOE makes Decenal mandatory not just for property developers but also for autopromotores — individuals building or commissioning a single home for their own use. There is one limited exception for self-build of one's own home with subsequent sale, but this is narrowly construed.
Self-builders typically pay €2,500–€4,000 for a single dwelling versus €8,000+ for developers building multiple units. The Organismo de Control Técnico (OCT) inspection — required by all decenal insurers — adds €1,500–€3,000 to the project but identifies issues during construction rather than after.
Related cover: RC obras and RC promotor
RC obras (Responsabilidad Civil de Obra) is site-liability insurance. It covers third-party claims during construction, such as an injured passer-by or damage to a neighbour's property. Many municipalities make it a condition of the building licence. RC promotor is the developer's civil liability for the 1- and 3-year warranties under the LOE that aren't covered by Decenal. Many municipalities also require an aval bancario or seguro de afianzamiento for off-plan sales — see our bond and aval insurance page.
Standard exclusions
Decenal covers structural defects (vicios o defectos) that affect resistance, stability or mechanical strength. It does not cover:
- Aesthetic damage — cracks that do not affect the structure
- Defects from work done by later owners
- Damage from extraordinary natural events — covered by the Consorcio
- Damage from owner negligence — failure to maintain the building
- Any damage where the OCT was stopped from inspecting during construction
Always keep the OCT certificate. Buyers' lawyers ask for it when the property is sold.
Constructor's Liability Insurance in Spain
Constructor's liability insurance Spain (Seguro de Responsabilidad Civil de Constructor) is essential for anyone carrying out building work in Spain. Under the Ley de Ordenación de la Edificación (LOE), everyone involved in the build is liable for structural defects. That liability runs for up to 10 years after the work is finished.
Who Needs Constructor's Liability?
- Building contractors and main contractors (constructores)
- Subcontractors and specialist trade contractors
- Property developers (promotores) — required by Spanish law
- Self-builders (autopromotor) carrying out their own construction
- Architects and technical architects (aparejadores)
- Renovation contractors — kitchens, bathrooms, extensions, pools
What Constructor's Liability Insurance Covers
- Third-party bodily injury during construction operations
- Third-party property damage caused during construction works

- Damage to underground services — pipes, cables, drains
- Temporary structures — scaffolding, hoarding, site cabins

All Risk Works Cover (Todo Riesgo de Construcción)
We can also arrange All Risk cover for the works themselves. It protects the building under construction against fire, storm, flood, collapse, theft of materials and malicious damage. The bank financing the build often insists on it.
