Legal framework

Commercial premises insurance is governed by Ley 50/1980 general property provisions. There is no national mandate to insure a commercial premises, but: (1) most leases require it as a condition of the tenant; (2) most lenders require it for premises with a mortgage; (3) most municipalities require liability cover as a condition of the licencia de actividad; and (4) some sectors (food preparation, healthcare delivery) have sector-specific liability requirements.

What's covered — the multi-risk standard

A standard seguro multirriesgo de comercio bundles: buildings + contents + stock; cash on premises and in transit (typically up to €3,000); civil liability for customers and third parties (typically €600,000 base, optional uplift to €1m+); theft and forced entry; glass and signage (frontage windows, neon signs); refrigerated stock spoilage (for food and pharmacy operations); loss of income from insurable damage (typically up to 6 months on standard, 12 months on enhanced); and 24-hour assistance for plumbers, locksmiths, electricians and glaziers.

Standard exclusions

Common commercial exclusions: cash above declared limits not in a declared safe; theft without forced entry (employee theft is a separate fidelity cover); stock variations beyond declared seasonal uplifts; cyber and data breaches (need separate cyber cover); professional liability for advisory services (need PI); events and pop-up activities not declared on the policy; and damage from building works beyond minor repairs.

Activity declaration is critical

Premium and cover scope depend on the actividad principal declared in the policy. Spanish insurers price activities using CNAE codes (the Spanish industry classification). Undeclared activities are excluded — running a small café area in a clothing store, or doing repairs in addition to retail, must be declared. CNAE changes (e.g., adding food service) typically require policy endorsement and sometimes a re-quote.

Frequently Asked Questions — Commercial & Office Insurance in Spain

Commercial property and office cover (Generali ON Comercios and similar) protects a small business premises and its contents. Here are the most common questions from Costa Blanca shop owners and small business proprietors.

Public liability is required by Spanish trading regulations for any premises open to the public — a shop, office accepting visitors, or any commercial space where a third party may suffer injury. Buildings cover is required by mortgage lenders. Employee cover under Convenio Colectivo is required if you have staff. Stock and contents cover is not legally required but is commercially essential.
Buildings cover (structure, fittings, fixtures if you own the premises); contents (stock, equipment, computers, furniture); public liability (claims from visitors injured on premises); employer's liability (employee injury claims); glass cover (shop frontage, internal glazing); theft (with forced entry conditions); loss of takings (when premises unusable after insured event); legal expenses (defensa jurídica).
Theft cover requires evidence of forced entry (broken locks, smashed glass, drilled doors, burglar tool damage). Theft from an unlocked premises, or by someone with legitimate access (an employee, a deliverer let inside) is not covered as theft — that's employee dishonesty (separate cover) or shoplifting (specific stock cover). Police report (denuncia) within 24 hours is required for all theft claims.
Many businesses have stock that varies dramatically by season (Christmas stock for retailers, harvest stock for food). Stock cover can be set at average yearly stock; maximum yearly stock with seasonal premium adjustment; or declared stock with annual return to true-up. Yes under contents, but with specific conditions: portable equipment (laptops) is sometimes only covered on premises, sometimes worldwide. Cyber attack causing equipment failure may not be covered under standard contents — it needs cyber cover. High-value individual items (a €5,000 server, an €8,000 colour printer) should be specifically scheduled. Backups should be off-site or cloud-based; data restoration is usually a cyber cover item.
Glass cover is normally a standalone benefit on commercial cover — large plate glass shop fronts are expensive (€2,000-€8,000 to replace) and frequently damaged by accidental, vandalism or break-in events. Cover usually has no excess (or low excess) for glass claims. Includes signage glass, internal partition glazing, and mirrored walls in retail.
If your business depends on the premises being open and operational — yes. After a fire/flood/major theft, you may be closed for weeks while rebuilding. Loss of takings (lucro cesante) pays out the equivalent profit you would have earned. Indemnity period typically 6-12 months, sometimes 18 months for businesses with longer recovery. Without it, you have repair costs AND zero income, which is a business-killer.
Goods being delivered to your business while in transit by your supplier are the supplier's responsibility (their goods in transit cover). Goods being delivered FROM your business by you to customers need your own goods in transit cover. Goods being collected by customers (at your premises) are on your premises and covered by contents cover until they leave.
Spanish employees are covered by the Social Security accident-at-work scheme as standard (paid by employer contributions). The Convenio Colectivo for your sector also requires private accident cover for typically €30,000-€60,000 of additional benefit. Together these provide medical care, sick pay during recovery, and disability/death benefits if needed. Employer's liability covers claims of negligence by injured employees against the employer.
Cash on premises is normally covered up to a small limit (€600-€2,500 standard). Cash in transit (going to bank) is covered separately. Cash held overnight in a fitted safe is covered up to a higher limit (typically €3,000-€8,000). Cash held loose overnight is usually not covered. All cash claims need police report and your security procedures must comply with the policy schedule.
External signs, awnings, illuminated displays are normally part of buildings cover if you own the premises, or contents if you rent. Storm damage, accidental damage and theft are typically covered. Light fittings damaged by power surge or lightning need specific cover (under all-risks contents or as a specific peril).
