Yes. Under the Ley de Propiedad Horizontal, all communities of owners (comunidades de propietarios) in Spain must hold community insurance covering the shared structure. Individual flat owners cannot opt out — the obligation falls on the community collectively, arranged through the president or appointed administrator.

Community insurance covers the shared structure (roof, load-bearing walls, shared staircases and lifts), communal areas (pool, gardens, parking under shared ownership), and public liability for injury or damage occurring in these areas. Individual apartments are not covered — each owner needs a separate home insurance policy for their own flat.

The responsibility lies with the community of owners collectively, typically delegated to the elected president or the professional property administrator (administrador de fincas).
