Communications and notifications between the Parties
You must contact us directly for any questions related to your policy. You can find out how to do this in the "How to Contact Us" section. Communications made by the policyholder to the insurance agent who mediates or has mediated in the contract will have the same effect as if they had been made directly to the insurance entity.
Communications made by an insurance broker to the Insurer on behalf of the policyholder will have the same effect as if made by the policyholder himself, unless otherwise indicated by the latter. Communications and notifications made by the Insurer to the Policyholder or the Insured through the insurance agent or broker who mediates or has mediated the operation will have the same effects as if they had been made directly by the Insurer.
1. Rules and form of communications and notifications between the parties by reason of this contract
All communications and notifications that the parties must make to each other by reason of this contract, related to its fulfillment and execution and/or for the exercise of the rights and obligations that arise from it must always be made in writing and will be governed by the provisions of this article of the policy.
Exceptionally, when the applicable regulations do not require that the communication be made in writing, those sent by the Insurer to the Policyholder and/or the Insured by telephone will be valid and have full effect when they are recorded on a durable medium that guarantees their integrity, provided that the recipient gives prior express consent for said recording.
2. Means of carrying out communications and notifications.
The insurer may make and send to the policyholder, the insured, beneficiaries and the heirs of any of them the communications and notifications referred to in point 1 above, with full legal validity and effectiveness and producing full contractual effects, by post, burofax, fax, by email or by text message (SMS) to a mobile phone.
In order for such communications and notifications, when made by mail or certified mail, to be effective, they must be addressed, in the case of those sent by the Insurer, to the address indicated in the policy by the Policyholder and/or the Insured, or to the address that they have notified to the Insurer after the issuance of the contract.
When the communications and notifications referred to in the previous paragraph are made by fax, by text message (SMS), or by email, they must be addressed, respectively, to the fax number, or the mobile phone number or the email address indicated in the policy by the Policyholder and/or the Insured, or to the one that they have subsequently notified to the Insurer or the intermediary who, if applicable, intervened in the contract.
All communications and notifications that the Policyholder and/or the Insured send to the Insurer must always be addressed to its registered office, as stated in the policy, or to any of its branches open to the public. This is without prejudice to the provisions of point 4 below regarding communications made through an insurance intermediary.
3. Effective date of the notifications and communications exchanged between the parties.
Communications and notifications exchanged between the parties will take effect from the moment they are received by the recipient party, regardless of whether or not the recipient reads them.
However, communications made by post or registered mail will have full contractual effect from the moment the Postal Service first attempts delivery to the recipient at their address (as established in point 2 above), regardless of whether that attempt fails for any reason. In the case of communications or notifications sent by email or text message (SMS) to a mobile phone, they will have full contractual effect from the date they are received at the destination email address or mobile phone number, regardless of whether the recipient opens the emails and/or SMS messages.

The Insurer guarantees payment of the established sum insured when, as a result of a covered accident, the Insured dies instantly or, due to the evolution of the injuries suffered, within one year from the date of the accident. For children under 14 years of age or legally incapacitated, the death benefit refers exclusively to the expenses of effectively justified funeral expenses, which in no case may exceed the sum insured for this coverage or at most the amount of €3,000. The amount of benefits paid for permanent disability, as a result of the same accident, is deducted from the benefits payable for death due to the same accident.
6.1.2. Permanent disability
- Up to the economic limit corresponding to the contracted modality.
The Insurer guarantees payment of the established insured sum when the Insured becomes Absolutely Permanently Disabled, which completely disables him from any profession or trade.
For these purposes, the risk of permanent total disability will only be considered to have occurred, after prior recognition of the same by means of a Resolution of the competent Administrative Body of Social Security or a final Judicial Resolution.
Limitation to coverage for partial and/or total permanent disability
In the event of an accident covered by the policy and affecting the partial and/or total permanent disability guarantee, the compensation will be reduced by the same percentage of disability suffered by the Insured prior to the date of the accident. Accidents resulting directly from such pre-existing disabilities are completely excluded.

The disability percentages considered for Right and Left are based on a right-handed person. Therefore, if the insured is left-handed, which they must duly prove, the aforementioned percentages will be reversed. Partial anatomical limitations and losses will be compensated proportionally to the total loss of the affected limb or organ. Absolute functional impairment of a limb or organ will be considered as a total loss of that limb or organ. In cases of disability not covered by the scale, the amount of the benefit is determined by analogy, proportionally to its severity, according to a medical opinion issued by a Specialist in the assessment of bodily injury.
The degree of disability to be taken into account, when the same accident causes various anatomical or functional losses, will be calculated by adding the percentages corresponding to each of them without said degree being able to exceed one hundred percent (100%).
If the disability resulting from an accident is aggravated by a pre-existing defect, mutilation or functional limitation, the percentage of compensation will be the difference between that of the pre-existing disability and that which results after the accident.
In the event of permanent partial disability suffered by the Insured as a result of an accident covered by the policy, which leaves residual injuries requiring orthopedic prostheses, the Insurer will pay the amount of the first prosthesis made for the Insured, up to the amount of €600.
6.1.3. Maximum compensation per claim in case of death due to accident and/or permanent disability
The maximum compensation per claim, in each group policy, will be that indicated for the option contracted. regardless of the number of insured parties affected by the same loss. If this limit is exceeded, the compensation will be distributed proportionally based on the insured capital for each affected party and the number of insured parties affected.
6.1.4. Scope of coverage
The Insurer guarantees up to the fixed sum, subject to the exclusions indicated in the General Conditions, the payment of compensation that may correspond in case of death or permanent disability as a result of accidents that occur to the Insured during trips and stays away from their usual residence.

6.1.5 INDEMNIFICATION CLAUSE BY THE INSURANCE COMPENSATION CONSORTIUM FOR LOSSES ARISING FROM EXTRAORDINARY EVENTS IN PERSONAL INSURANCE
In accordance with the provisions of the consolidated text of the Legal Statute of the Insurance Compensation Consortium, approved by Royal Legislative Decree 7/2004, of October 29, the policyholder of an insurance contract that must necessarily include a surcharge in favor of the aforementioned public business entity has the power to agree to the coverage of extraordinary risks with any insurance entity that meets the conditions required by current legislation.
Compensation arising from losses caused by extraordinary events occurring in Spain or abroad, when the insured has their habitual residence in Spain, will be paid by the Insurance Compensation Consortium when the policyholder has paid the corresponding surcharges in their favor and one of the following situations occurs:
- That the extraordinary risk covered by the Insurance Compensation Consortium is not covered by the insurance policy contracted with the insurance entity.

- In life insurance policies that, according to the contract and in accordance with the regulations governing private insurance, generate a mathematical reserve, the coverage provided by the Insurance Compensation Consortium will refer to the capital at risk for each insured party, that is, the difference between the sum insured and the mathematical reserve that the issuing insurance company is required to have established. The amount corresponding to the mathematical reserve will be paid by the aforementioned insurance company.
4. Notification of damages to the Insurance Compensation Consortium The request for compensation for damages whose coverage corresponds to the Insurance Compensation Consortium, will be made by communication to it by the policyholder, the insured or the beneficiary of the policy, or by whoever acts on behalf of and in the name of the above, or by the insurance entity or the insurance intermediary with whose intervention the insurance was managed.
