Generali Motor Insurance Policy Conditions (English Translation)

An English translation of the Generali Autos motor general conditions — the policy used for cars, vans and motorhomes in Spain.

⚠️ Important — please read. This is an AI translation produced on 5 June 2026 and is provided as a guide only to help English-speaking clients understand the cover. The policy wording may be amended by Generali at any stage. In the event of any legal dispute, the original Spanish version is the only binding text. The official document this translates is Generali Autos — Condiciones Generales (ref. GAU-1.26/GEN, edition G51232, 04/2026).

These are the General Conditions of the Generali Autos motor policy — the same wording that applies to cars, vans and motorhomes/campervans. They are completed by your Particular Conditions, which confirm the vehicle, the declared driver, the guarantees you selected and the sums insured. Only the guarantees listed in your Particular Conditions apply to you — compulsory third-party liability is always included; everything else is optional.

This is the policy for cars, vans and motorhomes. See the plain-English product pages: motorhome & campervan insurance, van insurance and car insurance — or the policy conditions hub.

Key concepts & definitions ↑ top

  • Insured / Policyholder / Declared driver: the owner of the vehicle, the person who takes out the policy, and the main driver named in the Particular Conditions.
  • Accident / driving event (Hecho de la circulación): an event arising from the use of the vehicle as defined in the compulsory motor-insurance regulation.
  • Third party (Tercero): any person other than the insured, the driver, the policyholder and their close family — broadly, who can claim against your liability cover.
  • Excess (Franquicia): the amount of a damage claim you bear, where the guarantee is taken with an excess (shown in the Particular Conditions).
  • Total loss (Pérdida total): where repair is uneconomic relative to the vehicle's value, as defined in the policy.
  • Green Card (Carta Verde): the international motor-insurance certificate recognised by the Council of Bureaux.

Article 1 — Object of the insurance ↑ top

The policy covers the consequences of owning and driving the insured vehicle, within the limits and guarantees stated in your Particular Conditions. Compulsory third-party liability is always included by law; the voluntary guarantees (Article 3) apply only when expressly taken out. Each guarantee has its own conditions and exclusions in addition to the general exclusions.

Part 2 — Liability cover

Article 2 — Compulsory third-party liability (RC Obligatoria) ↑ top

This is the cover required by Spanish law for every vehicle. It pays, up to the legally-set limits, for personal injury and property damage you cause to third parties with the vehicle. Not covered by the compulsory cover: the driver's own injuries; damage to the insured vehicle itself and to property belonging to the insured, driver, policyholder or their close relatives; and fines/penalties. The insurer has a right of recovery (derecho de repetición) against the driver in cases such as driving under the influence, without a valid licence, or when the vehicle was stolen.

Articles 3.1–3.3 — Voluntary liability ↑ top

Optional cover that tops up the compulsory liability and fills its gaps:

  • Limited Voluntary Liability (3.1) — pays indemnities and bonds in excess of the compulsory limits.
  • Liability Extension / Plus (3.2–3.3) — raises total liability cover to a maximum of €50,000,000 per claim, and can extend to liability for goods carried and for the property of the insured/driver/family in certain cases.

Part 3 — You & your passengers

Articles 3.6–3.9 — Personal accident, medical & hospitalisation ↑ top

  • Personal accident (3.6–3.7) — pays the sums insured in the Particular Conditions for death or permanent disability of the driver and/or occupants from a driving accident, plus medical costs, home help and (where extended) a funeral benefit.
  • Second medical opinion (3.8) — access to an expert second opinion for a serious diagnosis.
  • Hospitalisation benefit (3.9) — a daily cash amount for each day in hospital after a covered accident.

Article 3.10 — Travel & breakdown assistance ↑ top

24-hour roadside and travel assistance for the vehicle and its occupants — breakdown and accident recovery, towing, roadside repair, onward travel, overnight accommodation and vehicle repatriation, on the terms and from the kilometre from home stated in Annex I of the policy.

Part 4 — Your vehicle

Articles 3.11–3.18 — Damage to your vehicle ↑ top

  • Glass breakage (3.11) — repair or replacement of windscreen and windows.
  • Fire (3.12) — damage from fire, explosion or lightning.
  • Theft / unlawful taking (3.13) — theft of the vehicle or its parts, and damage caused by theft or attempted theft.
  • Forces of nature (3.14) — storm, flood, hail and similar (events not falling to the Consorcio).
  • Total loss by theft, damage or fire (3.15) — settlement of the vehicle's insured value on a total loss.
  • Own damage / comprehensive (3.16–3.17) — accidental damage to your own vehicle (“todo riesgo”), available with or without an excess; the extension widens what is covered.
  • Collision with animals (3.18) — damage from hitting an animal, typically without applying an excess.

Articles 3.19–3.21 — Replacement vehicle & more ↑ top

  • Replacement vehicle (3.19) — a courtesy/replacement vehicle while yours is repaired or after a total loss, on the terms contracted.
  • Licence withdrawal (3.20) — a monthly indemnity if your driving licence is withdrawn.
  • Vehicle immobilisation (3.21) — a daily indemnity while the vehicle is off the road after a covered claim.

Part 5 — Scope, exclusions & claims

Article 3.22 — Territorial scope & Green Card ↑ top

Compulsory liability applies across the European Economic Area and the countries in the Green Card (Carta Verde) system. The voluntary guarantees apply within the territorial scope stated in your Particular Conditions. The Green Card is the international certificate proving your cover when driving abroad.

Article 3.23 — General exclusions (voluntary cover) ↑ top

The voluntary guarantees do not, in general, cover claims arising from, among others:

  • Driving under the influence of alcohol or drugs, or without a valid, in-date driving licence for the vehicle.
  • Wilful acts of the driver/insured, and use of the vehicle for a purpose other than the one declared (e.g. racing, hire or driving tuition unless declared).
  • Races, competitions and their trials; overloading or carrying more passengers than authorised.
  • War, terrorism, riots and extraordinary events covered by the Consorcio; nuclear/radioactive risks.
  • Damage to goods carried, and pre-existing damage or wear, mechanical/electrical breakdown, and depreciation.
  • Fines and penalties, and the consequences of not paying them.

Articles 4–5 — Risk valuation & indemnity ↑ top

The premium and cover depend on the information you declare — in particular the declared driver, the vehicle's use and where it is kept. You must tell Generali of any aggravation of the risk (e.g. a change of main driver or use) and on transfer of the vehicle. On a claim, the vehicle and damage are valued under Article 5; for a total loss the insured value (or market value, as applicable) is paid, and the insurer may settle by repair, replacement or cash.

Extraordinary risks (Consorcio de Compensación de Seguros) ↑ top

Losses from extraordinary events (earthquakes, tsunamis, extraordinary floods, volcanic eruptions, atypical cyclonic storm, falling meteorites; terrorism, rebellion, riot; and acts of the Armed/Security Forces in peacetime) are indemnified by the public Consorcio de Compensación de Seguros, funded by a surcharge collected with your premium, under Royal Legislative Decree 7/2004 and RD 300/2004. For motor policies, the Consorcio also acts as guarantee fund in defined cases (e.g. an unknown or uninsured at-fault vehicle).
