Generali Maritime & Transport Liability (RC's Marítimas) Conditions

Generali's civil-liability policy for carriers, freight forwarders and transport operators, in plain English.

⚠️ Important — please read. This is an AI translation produced on 5 June 2026, provided as a guide only. The wording may be amended by Generali at any stage, and in any dispute the original Spanish version is the only binding text. The official document is Generali RC's Marítimas y de Transportes — Seguro de RC's Marítimas y de Transporte (ref. RT 037/GEN, edition G51318, 01/2026).

This is a commercial civil-liability policy for the maritime and transport industry — carriers, freight forwarders (transitarios), logistics operators, NVOCCs and port/terminal operators. Unlike the cargo policies, it does not insure the goods themselves; it covers your legal liability for the damage and loss your transport business may cause. It is one of Generali's four transport insurance options.

The cover

Object & territory ↑ top

Generali takes on the financial consequences of the civil liability the insured may incur for personal injury, property damage and consequential loss caused involuntarily to third parties through carrying on its maritime and transport business, as agreed in the Particular Conditions. The cover can optionally be extended to the insured's own equipment. Territory: the European Union (damage occurring in the EU and claimed before its courts), unless otherwise agreed.

The policy is modular — you contract one or more of the five covers below.

1. Third-party liability ↑ top

Liability for death or bodily injury of third parties (including hospital, medical and funeral costs), damage to third-party property, sudden and accidental pollution, and the consequential losses arising from these. It does not cover injury to the insured's own employees or subcontractors, motor-vehicle liability, or damage to the insured's own or leased property.

2. Cargo liability ↑ top

Liability for loss of or damage to cargo while it is under the insured's custody or control; delays in delivery; and errors in shipping or delivery (sending to the wrong person or destination, failure to deliver or to collect the proper documents). It includes general-average or salvage contributions the insured is legally liable for and cannot recover from its customers. It excludes contractual deadline penalties, declared/agreed cargo values (unless pre-agreed in writing), and certain goods (precious metals and jewellery, banknotes, securities, art and antiques, live animals, and dangerous goods unless pre-agreed).

3. Errors, omissions & liability to authorities ↑ top

Claims against the insured arising from negligent acts, errors or omissions committed in good faith in providing the services — including customs-duty breaches, short or excess delivery, breaches of import/export and documentation rules, immigration breaches, and breaches of environmental-pollution regulations. It does not cover criminal acts, or fines and penalties.

4. Wreck removal ↑ top

The costs the insured is legally obliged to incur for the removal of the wreck of a vessel sunk or made derelict by an accident during the policy; the storage, removal, retrieval or marking of abandoned or accident-damaged cargo or equipment; and the quarantine or disinfection of cargo, equipment or buildings. Cover is limited to amounts not recoverable elsewhere and only where needed to avoid or reduce a claim under covers 1 or 2.

5. Equipment insurance ↑ top

For the insured's own or leased equipment, containers and handling machinery: loss or damage from an accident (up to the equipment's real value); general-average and salvage contributions; and the daily rental cost of replacement while damaged equipment is repaired or replaced (maximum 30 days, after a 2-day excess). It excludes wear and tear, manufacturing or design defects, electrical or mechanical breakdown of the equipment itself, and equipment while leased out to a third party.
