The legal framework, specific waiting periods, exclusions and citations every prospective policyholder should know. Sources are linked inline to the BOE (Boletín Oficial del Estado) and Spanish regulators.
Legal framework and minimum cover
Motorbike insurance in Spain falls under RDL 8/2004 (LRCSCVM) with the same compulsory minimums as cars: €70 million personal injury / €15 million property damage per accident. Bikes from 50cc up are subject to mandatory third-party cover. The Tarjeta del seguro (insurance certificate) must be carried at all times and the bike must hold a current ITV (every 4 years for motos under 125cc, then biennial).
Cover tiers and helmet/gear cover
Standard tiers: terceros (compulsory only), terceros ampliado (adds theft, fire, glass), todo riesgo con franquicia (excess applies — typically €300–€600), and todo riesgo sin franquicia. Helmet and protective-gear cover (typically €400–€600) is included in most ampliado and todo riesgo tiers, paying for replacement of damaged helmet, jacket, gloves and boots after an accident — useful because high-quality kit is expensive and not covered as personal effects under home insurance.
Standard exclusions
Track days, racing and competitive use — excluded unless specifically added. Off-road riding on a road-only registered bike. Driving above alcohol limit (0.5g/l, 0.3g/l for newly-licensed). Pillion passengers not declared on the policy. Modifications not declared (exhaust, ECU remap, suspension). Damage when the bike was left unsecured outdoors overnight (theft cover typically requires garage or chained to a fixed object).
The 2-year rule for new riders
Spanish motorcycle licensing has graduated steps: AM (mopeds, age 15), A1 (125cc, age 16), A2 (35kW power restriction, age 18), A (unrestricted, after 2 years on A2 OR direct at age 20). Insurers apply premium loading to riders within their first 2 years of licence and many decline cover for higher capacity bikes in that period. Always declare licence date accurately.

Motorbike Insurance Spain — What is Covered
- Civil liability (obligatoria): Mandatory third-party liability for bodily injury and property damage caused to other road users. Required by Spanish law for all motorcycles without exception, including mopeds and scooters over 49cc
- Extended civil liability: Additional voluntary third-party cover beyond the legal minimum — important given the potential severity of motorcycle accident claims involving third-party injuries
- 24-hour European breakdown assistance: Roadside assistance anywhere in Europe — towing, transport for the rider, and accommodation if the bike cannot be repaired the same day. Unlimited towing distance for full policies
- Fire protection: Damage caused by fire including engine fire, garage fire and arson
- Theft — total and partial: Total theft of the motorcycle; partial theft of components (wheels, battery, exhaust system, mirrors, GPS units). Damage during theft attempt (forced locks, damaged bodywork)
- Glass and screen breakage: Windshield, instrument screen and any glass elements specific to touring motorcycles
- Legal defence: Legal representation following an accident — defence costs, court representation and traffic tribunal proceedings
- Compensation recovery: Legal assistance to recover damages from the at-fault party if you are not responsible for an accident
- Occupant personal accident: Death and permanent disability cover for the rider — particularly important given the higher risk profile of motorcycles compared to cars
Optional Extras — Motorbike Insurance Spain
- Comprehensive own damage (todo riesgo): All damage to the motorcycle itself — collision damage, overturning, parking damage, crash damage at low speed, impact with road debris. Available with or without a voluntary excess. Essential for new or high-value motorcycles
- Pillion passenger accident cover: Additional personal accident cover for a regular pillion passenger — particularly relevant for couples who ride together frequently
- Riding equipment cover: Helmets, leathers, protective jackets, gloves and boots — cover for damage to riding equipment in an accident and theft
- Accessories and customisation: Aftermarket exhaust systems, custom paintwork, panniers, top boxes, GPS systems and custom parts not covered under standard vehicle value
- Protected no claims discount: Protect your accumulated no claims bonus — one at-fault claim in a policy year does not reduce your NCD at renewal
- Agreed value (valor pactado): For rare, classic, restored or high-value custom motorcycles — insured value is agreed at policy inception to avoid disputed valuations at total loss
- Roadside recovery to home: Standard breakdown cover takes the bike to the nearest garage. This extension allows the bike to be recovered to your chosen workshop or home address anywhere in Spain
- Replacement motorcycle hire: A replacement motorcycle while yours is being repaired — so you are not without transport during the repair period
