Legal framework

Decennial structural insurance (Seguro Decenal) is mandatory for new residential construction under Ley 38/1999 de Ordenación de la Edificación (LOE). The cover is a 10-year structural warranty running from the date of acta de recepción (final acceptance certificate). Without it, the building cannot be registered in the Property Registry and the title deed (escritura pública de obra nueva) cannot be executed.

The three-tier LOE warranty system

Article 17 of the LOE establishes three tiers of mandatory builder warranty: 1 year for finishes and minor works defects (paint, tiles, doors); 3 years for habitability defects (insulation, ventilation, water-tightness from non-structural causes); and 10 years for structural defects affecting load-bearing elements (foundations, columns, beams, slabs, walls). Only the 10-year structural cover requires insurance under the LOE — the shorter warranties are direct-builder obligations, but RC obras insurance (see below) covers them in practice.

Self-builders (autopromotor)

Article 19.1 LOE makes Decenal mandatory not just for property developers but also for autopromotores — individuals building or commissioning a single home for their own use. There is one limited exception for self-build of one's own home with subsequent sale, but this is narrowly construed.

Self-builders typically pay €2,500–€4,000 for a single dwelling versus €8,000+ for developers building multiple units. The Organismo de Control Técnico (OCT) inspection — required by all decenal insurers — adds €1,500–€3,000 to the project but identifies issues during construction rather than after.

RC obras (Responsabilidad Civil de Obra) is site-liability insurance covering third-party claims during construction (passers-by injured, neighbours' property damaged) — mandatory in many municipalities as a condition of building licence. RC promotor is the developer's civil liability for the 1- and 3-year warranties under the LOE that aren't covered by Decenal. Many municipalities also require an aval bancario or seguro de afianzamiento for off-plan sales — see our bond and aval insurance page.

Standard exclusions

Decenal covers structural defects from vicios o defectos that affect resistance, stability or mechanical strength. It excludes: aesthetic damage (cracks not affecting structure); defects from work carried out by subsequent owners;

damage from extraordinary natural events (covered by the Consorcio); damage from owner negligence (failure to maintain); and any damage where the OCT was prevented from inspecting during construction. Always retain the OCT certificate — it is required by buyers' lawyers when the property is sold.

Spanish construction has multiple layers of compulsory insurance under the Ley de Ordenación de la Edificación (LOE). Builders, developers and self-builders need to understand each. Here are the questions we are asked most often.

Seguro Decenal is a 10-year structural warranty insurance required by Spanish law (LOE, Ley 38/1999) for all new residential buildings. It covers structural defects affecting the stability and habitability of the building for 10 years from completion. It is mandatory before the building licence (licencia de primera ocupación) is issued. Self-builders (autopromotor) building their own home are also subject — though some self-build exemptions exist.
Premium is typically 0.4-1.2% of total construction value, paid as a single premium at building completion (when the OCT. Organismo de Control Técnico — has approved the structure). For a €300,000 villa build, expect €1,500-€3,500 Decenal premium. The OCT inspection itself is a separate cost (€2,000-€5,000) but is essential and required by Spanish law.
RC Obras is liability cover for the works in progress — covers third-party damage caused during construction (worker injury to neighbours, dust damage to adjacent buildings, accidental damage from machinery). It runs throughout the build period and finishes when the project completes. RC Obras is part of standard contractor liability cover, not Decenal which is post-completion.
Required by most municipality building permits before licencia de obras is granted. The town hall checks for valid RC during the construction period. Premium is typically 1-3% of construction value, depending on the build type and risk. Larger and more complex projects (high-rise, industrial) attract higher rates.
RC Promotor (developer civil liability) covers a property developer's exposure as the legal client of construction works. Different from RC Obras (which covers the contractor doing the building). RC Promotor includes pre-sale customer claims, defects emerging during/after construction, and contractual disputes with buyers. Standard for multi-unit developments and recommended for self-promoters of single villas.
Some main contractor RC includes vicarious liability for subcontractors, meaning if a subcontractor is sued and unable to pay, your insurance covers it. More commonly, subcontractors should hold their own RC liability — the main contractor's policy is the safety net only. We help contractors verify their subcontractors' insurance at hire stage.
OCT (Organismo de Control Técnico) is an independent technical control body that inspects the building during construction to validate structural compliance. The OCT report is required for Seguro Decenal issue. The OCT visits at key construction phases (foundations, structural completion, final). Without a satisfactory OCT report, no Decenal can be issued and no licencia de primera ocupación will be granted.
Personal-use homes that won't be sold are sometimes exempt — but Decenal is still required if the property might be sold within 10 years of completion. The exemption is challenged by recent Supreme Court rulings. Most legal advisors now recommend Decenal for all autopromotor builds for protection against future sale complications.
Tool theft from sites is a major issue for trades — often the largest claim category. Tool cover under contractor policies typically €1,500-€10,000 with conditions: locked van/site box, security at site, registered serial numbers for high-value items. Yes. Spanish construction workers are covered by the Convenio General de la Construcción (the construction sector collective agreement) which requires accident-at-work cover from each employer. This is on top of standard Spanish social security accident scheme. Premium is typically €40-€100 per worker per year. Site safety plans (Plan de Seguridad y Salud) are also legally mandatory under construction law.

Run-off cover for past projects is also important when a construction company is wound up.
Decenal claims are typically handled by the insurer's specialist construction defect team — they investigate, instruct experts, and either settle or defend on your behalf. RC Obras claims are similarly handled. As the insured contractor or developer, you cooperate with the investigation but the insurer manages the legal process. We act as your interface throughout.
Yes — under Spanish law, claims must be notified within 7 days of the contractor or developer becoming aware of the issue. Late notification is a frequent reason for claim decline. The clock starts when the issue is reported to you, not when you decide whether to engage with it. Always notify and let the insurer assess, even for issues you think will resolve themselves.
Not for self-employment — if you want to work as a self-employed tradesperson in Spain you need Spanish qualifications. If you are seeking employment with an established firm, that is a different matter. Your UK qualifications may or may not transfer — check with the relevant Spanish trade association. Insurance requires you to be legally entitled to perform the work; cover for unauthorised installations may be void.
